Zurag.online Terms of Service

Welcome to Zurag.online! These Terms of Service ("Terms") govern your access to and use of Zurag.online ("we", "us", "our", or the "Service"), including any content, functionality, and services offered on or through Zurag.online. By creating an account, accessing, or using the Service, you agree to comply with and be bound by these Terms.

1. Acceptance of Terms

By using Zurag.online, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you may not use our Service.

2. Eligibility

You must be at least 18 years old to use Zurag.online. By using our Service, you represent and warrant that you meet this age requirement.

3. Account Registration

To access certain features of Zurag.online, such as purchasing or selling photos, you must create an account. You agree to provide accurate and complete information during registration and to keep your account information up to date. You are responsible for maintaining the confidentiality of your account and password, and you agree to notify us immediately of any unauthorized use of your account.

4. User Responsibilities

You agree that you will not:

  • Use the Service for any illegal or unauthorized purpose.
  • Upload or share any content that is unlawful, harmful, or infringes on the intellectual property rights of others.
  • Disrupt or interfere with the security or functionality of the Service.

We reserve the right to terminate your account for any breach of these Terms or any applicable law.

5. Intellectual Property

All content available on Zurag.online, including but not limited to text, graphics, images, and code, is the property of Zurag.online or its content suppliers and is protected by intellectual property laws. You may not use, reproduce, or distribute any content without the express permission of the rights holders.

6. Photographer's Rights

Photographers who upload images to Zurag.online retain all intellectual property rights to their images. By uploading images, photographers grant Zurag.online a worldwide, non-exclusive license to use, display, and sell these images through the platform. Photographers agree not to upload content that they do not own or have rights to distribute.

7. Purchasing Photos

Customers may purchase photos directly through the Zurag.online platform. Once a purchase is made, the customer gains the right to download the purchased image. The ownership of the image remains with the photographer unless otherwise specified. Purchased images are for personal use only and may not be redistributed, resold, or used commercially without the photographer's consent.

8. Refund Policy

Refunds are generally not provided for digital products once they have been downloaded. In cases where a purchased image is corrupted, incomplete, or of significantly lower quality than represented, please contact us at admin@zurag.online for assistance.

9. Commission and Payments

Zurag.online collects a commission on each photo sale made through the platform. The base commission rate is 25%. Photographers who achieve higher monthly sales volumes may qualify for reduced rates:

  • Monthly sales under ₮500,000: 25% commission (photographer keeps 75%).
  • Monthly sales ₮500,000 – ₮2,000,000: 22% commission (photographer keeps 78%).
  • Monthly sales over ₮2,000,000: 20% commission (photographer keeps 80%).

Commission tiers are calculated based on trailing 30-day sales and applied automatically. Tips from buyers are passed 100% to the photographer with no platform commission. Zurag.online reserves the right to adjust commission rates with 30 days' notice.

9.1 Payouts

Photographers may request withdrawal of their earnings at any time, subject to a minimum payout amount of ₮50,000. Payouts are processed via bank transfer on a weekly batch schedule. Zurag.online reserves the right to hold payouts for up to 48 hours after a sale to allow for dispute resolution.

10. Storage and Hosting

Each photographer account includes 30 GB of free storage for original uploaded images. Storage usage is measured by original file size only; processed derivatives (thumbnails, watermarked versions) do not count toward your quota.

  • Grace buffer: No overage charges are applied for usage up to 33 GB.
  • Overage billing: Usage above 33 GB is billed at ₮1,000 per GB per month, based on peak usage during the billing period. Overage charges are deducted from your photographer balance on the 1st of each month.
  • Hard limit: Uploads are rejected when total storage reaches 100 GB. To continue uploading, you must delete existing content to free space.

Zurag.online reserves the right to adjust storage limits and overage rates with 30 days' notice.

11. Content Deletion

Photographers may delete individual photos or entire albums from the platform. Deletion is subject to the following conditions:

  • Photos that have been purchased by buyers cannot be deleted.
  • When a photo is deleted, its original file and all processed variants are permanently removed from our servers.
  • Deleting an album will delete all non-purchased photos within it.
  • Storage usage is reduced immediately upon deletion, but peak usage for billing purposes is not affected retroactively.

12. Privacy

Your use of Zurag.online is also governed by our Privacy Policy, which explains how we collect, use, and share your personal data.

13. Termination

Zurag.online reserves the right to suspend or terminate your account at any time for any reason, including but not limited to a violation of these Terms. Upon termination, your right to use the Service will immediately cease, and any unpaid amounts owed to you will be processed according to our payment policies.

14. Limitation of Liability

To the maximum extent permitted by law, Zurag.online shall not be liable for any indirect, incidental, special, or consequential damages resulting from your use of, or inability to use, the Service, even if we have been advised of the possibility of such damages.

15. Indemnification

You agree to indemnify and hold Zurag.online, its affiliates, officers, directors, and employees harmless from any claims, losses, damages, or expenses (including legal fees) arising out of your use of the Service, your breach of these Terms, or your violation of any law or the rights of a third party.

16. Modifications to the Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will provide notice via email or by posting a notice on our website. Your continued use of the Service following any changes to these Terms will constitute your acceptance of the new terms.

17. Governing Law

These Terms are governed by and construed in accordance with the laws of Mongolia, without regard to its conflict of law principles. You agree to submit to the exclusive jurisdiction of the courts of Bayangol district of Ulaanbaatar for any dispute arising out of these Terms.
